I was pulled over for OVI in Ohio last November. The officer had me do the field sobriety tests. After I finished he put me in the back of the car and said I was under arrest for OVI. He asked me if I would submit to a breath test and I said no. At that point he read me my rights and wrote me out a ticket for OVI. But instead of taking me back to the station or to jail he took me home. After reading the article on refusal my question is will the charge of refusal hold up. How could I refuse the test if I never went to the station.
